Privacy Policy

1. Who we are

UXDivers S.A. ("UXDivers", "we", "us") is responsible for the personal data described in this policy. Our address is Echevarriarza 3535, Apt. 807, Montevideo, Uruguay. You can contact us about privacy at hello@uxdivers.com
This policy explains how we handle personal data when you visit uxdivers.com, contact us through the website or email, request a conversation, or subscribe to our newsletter. Information is held in electronic systems used to manage inquiries, business relationships, communications and website analytics.

2. Information we collect

You may provide your name, business email, company, role, contact details, project information and any other information included in your messages or forms. We also keep correspondence needed to handle your request.

Our website and service providers may process technical information such as IP addresses, browser and device details, pages visited, referral sources, campaign parameters, timestamps, cookie identifiers and interactions with links or forms. The information collected depends on the services enabled and your privacy choices.

Required form fields are identified on the form. Other fields are optional. Without accurate contact information and sufficient details, we may be unable to respond or arrange the assistance you request. Please avoid submitting sensitive personal information or confidential third-party information through general inquiry forms.

3. How and why we use information

We use personal data to:
  • Respond to inquiries, discuss projects and arrange meetings.

  • Prepare proposals and manage business communications and relationships.

  • Send newsletters and updates when you have subscribed.

  • Understand website use and campaign performance, including visits from partner publications and clicks on resources.

  • Operate and protect the website, troubleshoot problems and meet applicable legal obligations.

Depending on the activity and applicable law, processing is based on your consent, steps requested before entering a contract, performance of a contract, legal obligations, or legitimate interests where that basis is available. Those interests include handling business communications and maintaining a secure, effective website, subject to your rights.

Submitting an inquiry does not automatically subscribe you to marketing. You can unsubscribe from marketing emails using their unsubscribe link or by contacting us. Withdrawal of consent does not affect the lawfulness of earlier processing.

4. Cookies and website analytics

We use cookies and similar technologies for website functionality and, where enabled with the required consent, analytics and measurement. Google Analytics helps us understand website traffic and interactions. HubSpot supports our forms and contact management and may associate website activity with an identified contact where its tracking is enabled and permitted.

Where consent is required, optional tracking is activated only after consent. You can change or withdraw your choices at any time through the "Preferences" button (with a cookie icon) at the bottom-left corner of every page, or through the "Preferences" option in the cookie banner. You can also manage cookies in your browser; blocking essential cookies may affect website functionality.

5. Who receives information

Authorized UXDivers team members access information as needed for their responsibilities. We also use service providers to support our operations, including:
  • Webflow: website hosting and delivery of website assets.

  • HubSpot: forms, contact management and communications; website tracking where enabled.

  • Google Analytics: website analytics and campaign measurement.

  • Google Workspace: business email, calendars and document collaboration.

We may disclose information to professional advisers or competent authorities when necessary to meet legal obligations or protect legal rights. We do not sell personal data. Links to partner websites are governed by those websites' own privacy policies.

6. International processing

UXDivers is based in Uruguay. Using the service providers described above may involve processing personal data in other countries.

7. How long we keep information

We retain information for the purposes described in this policy and applicable legal requirements:
  • Inquiries and prospective business relationships: for as long as needed to respond to your request and manage the business relationship, and afterwards for as long as we have a legitimate interest or legal need to keep the correspondence.

  • Newsletter subscriptions: while subscribed; after an unsubscribe, limited records may be retained to respect your preference and document consent, for as long as necessary for that purpose.

  • Analytics data and cookies: for the periods set by each provider and the lifetime of each cookie. You can review the cookies and providers in the cookie preferences panel.

  • Contractual, accounting or legal records: for the periods required by applicable law or necessary to establish, exercise or defend legal claims.

Information is then deleted or anonymized, subject to documented backup retention and legal holds where applicable.

8. Your rights

Under Uruguay's Law No. 18,331 and other applicable data protection laws, you may request access to your personal data, correction, updating, inclusion or deletion, as applicable. Depending on the law that applies, you may also have rights to object, restrict processing or receive portable data. You can withdraw consent where processing relies on it.

Contact hello@uxdivers.com to make a request. We may ask for information reasonably needed to verify your identity and will respond within applicable legal time limits. Some requests may be subject to lawful exceptions, which we will explain.

You may raise a complaint with Uruguay's Unidad Reguladora y de Control de Datos Personales (URCDP): https://www.gub.uy/unidad-reguladora-control-datos-personales/. Where applicable, you may also contact your local supervisory authority.

We do not use website information to make decisions based solely on automated processing that produce legal or similarly significant effects on you.

9. Security

We use appropriate organizational and technical safeguards to protect personal data, including limiting access to people who need it for their work. No system or transmission method can be guaranteed completely secure.

10. Changes and contact

We may update this policy as our services, practices or legal obligations change. The latest version will appear on this page with an updated date. Where required, we will provide additional notice or obtain consent for relevant changes.
